Fong Brothers’ furniture is custom and made to order based on the customer’s specifications. Once built, a product becomes a unique item for that particular order. As a result, it can be difficult to resell an item if the order is cancelled.
All cancellations must be made in writing.
All shipping charges are F.O.B. Los Angeles, California, unless otherwise noted. Risk of loss and damage shall pass to Purchaser when products are delivered to carrier. Fong Brothers will ship via the Purchaser’s preferred carrier. If a carrier is not provided, Fong Brothers will ship via an economical 3rd party carrier. Shipping charges, including insurance, will be added to your invoice prior to shipping. You should inspect all items for damage prior to signing. Signature of receipt by your agent, customer, or employee constitutes full acceptance of all packages stated on the bill of lading in undamaged condition. You are responsible for all shipping and return charges for any shipment that is refused as well as forfeiture of your deposit. We shall not be liable for delay in shipment for any cause, nor shall any delay entitle you to cancel any order after it has shipped. You agree that the shipping address provided to Fong Brothers in writing is a valid commercial shipping address. Residential addresses must be called out as such and additional charges may be imposed by carrier for such deliveries. All orders are shipped complete unless multiple/split shipments are requested or approved by Purchaser.
Upon delivery, the Purchaser agrees to the following:
Claims for damage to products that do not arise from defects in material or workmanship are the responsibility of the carrier. If the shipment arrives with visible exterior damage (crushed box, broken crate, moisture, etc) note the damage in writing on the carrier’s delivery receipt before you sign for the shipment and release the delivery driver. A claim for shipping damages will not be accepted by Fong Brothers unless the damages are noted on the carrier’s delivery receipt.
Fong Brothers will, at our option, repair or replace the damaged item(s). If damaged item(s) are to be returned for repair, shipping arrangements must be approved by Fong Brothers. Non-authorized return shipments will be refused at Purchaser’s cost.
